SMPL International BV cares deeply about your privacy. We therefore only process data that we need for (improving) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the websites (https://www.smpl.international; https://members.smpl.international; https://investeer.smpl.international) and the services provided by SMPL International BV through them. The effective date for these terms is 15/11/2019; the publication of a new version renders all previous versions invalid. This privacy policy describes what data we collect about you, what this data is used for, and with whom and under what conditions this data may be shared with third parties. We also explain how we store your data, how we protect your data against misuse, and what rights you have regarding the personal data you have provided to us.

Web store software

Swell

Our web store uses software from Swell. Personal data that you provide to us for the purpose of our services is shared with this party. Swell has access to your data to provide us with (technical) support; they will never use your data for any other purpose. Based on the agreement we have concluded with them, Swell is required to take appropriate security measures. These security measures consist of the use of SSL encryption and a strong password policy. Swell uses cookies to collect technical information regarding your use of the software; no personal data is collected and/or stored. Swell reserves the right to share collected data within its own group to further improve its services.

Web hosting

Webflow

We use web hosting and email services from Webflow. Webflow processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata regarding the use of the services. This is not personal data. Webflow has taken appropriate technical and organizational measures to prevent the loss and unauthorized use of your personal data. Webflow is bound by a confidentiality agreement.

Cloud86

We use web hosting and email services from Cloud86. Cloud86 processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata regarding the use of the services. This is not personal data. Cloud86 has taken appropriate technical and organizational measures to prevent the loss and unauthorized use of your personal data. Cloud86 is bound by a confidentiality agreement.

Email and mailing lists

Swell

We send our newsletters and transactional emails in part using our webshop software, Swell. All confirmation emails you receive from our website and web forms are sent via Swell’s servers. Swell will never use your name and email address for its own purposes. At the bottom of every email sent automatically via our website, you will find an ‘unsubscribe’ link. If you click this, you will no longer receive emails from our website. Please note that this may significantly impair the functionality of our website. Your personal data is transmitted, stored, and accessed securely by Swell. Swell uses cookies and other internet technologies to track whether emails are opened and read. Additionally, Swell processes information about you as the recipient and the email subject line to improve the quality of its services; this data is stored for 30 days. Swell reserves the right to use your data to further improve its services and, in that context, to share information with third parties.

Omnisend

We send our email newsletters in part using Omnisend. Omnisend will never use your name and email address for its own purposes. At the bottom of every email sent automatically via our website, you will find an ‘unsubscribe’ link. If you click this, you will no longer receive our newsletter. Your personal data is stored securely by Omnisend. Omnisend uses cookies and other internet technologies to track whether emails are opened and read. Omnisend reserves the right to use your data to further improve its services and, in that context, to share information with third parties.

Cloud86

We use Cloud86 for our regular business email correspondence. This party has implemented appropriate technical and organizational measures to prevent the misuse, loss, and corruption of your and our data as much as possible. Cloud86 does not have access to our mailbox, and we treat all our email correspondence confidentially.

Payment processors

Mollie

We use the Mollie platform to handle (part of) the payments in our webshop. Mollie processes your name, address, and city details, as well as your payment information, such as your bank account or credit card number. Mollie has implemented appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve its services and, in that context, to share (anonymized) data with third parties. All the aforementioned safeguards regarding the protection of your personal data also apply to the parts of Mollie’s service for which they engage third parties. Mollie does not store your data longer than permitted by law.

Klarna

To offer you Klarna’s payment methods, we must transfer your personal data to Klarna. This only happens when you choose to pay with Klarna. Klarna uses this data to assess whether you are eligible to use their payment methods. The personal data involved includes your name, address, phone number, payment history, and order details, such as the payment method, delivery address, ordered products, and similar information. Your personal data is processed by Klarna in accordance with applicable data protection laws and as described in Klarna’s privacy statement.

Shipping and logistics

SendCloud

When you place an order with us, it is our responsibility to ensure your package is delivered to you. We use the services of SendCloud to handle our deliveries. To do this, we must share your name, address, and city details with SendCloud. SendCloud uses this information solely for the purpose of fulfilling the agreement. If SendCloud engages subcontractors, they will also provide your details to these parties.

MyParcel

When you place an order with us, it is our responsibility to ensure your package is delivered to you. We use the services of MyParcel to handle our deliveries. To do this, we must share your name, address, and city details with MyParcel. MyParcel uses this information solely for the purpose of fulfilling the agreement. If MyParcel engages subcontractors, they will also provide your details to these parties.

Invoicing and accounting

Moneybird

We use the services of MoneyBird to maintain our administration and bookkeeping. We share your name, address, and city details, as well as details regarding your order. This data is used for administering sales invoices. Your personal data is transmitted and stored securely; MoneyBird has implemented the necessary technical and organizational measures to protect your data against loss and unauthorized use. MoneyBird is bound by confidentiality and will treat your data confidentially. MoneyBird does not use your personal data for any purposes other than those described above.

External sales channels

Bol.com

We sell (a portion of) our items via the Bol.com platform. If you place an order through this platform, Bol.com shares your order and personal details with us. We use this data to process your order. We handle your data confidentially and have implemented appropriate technical and organizational measures to protect your data against loss and unauthorized use.

Marktplaats.nl

We sell (a portion of) our items via the Marktplaats.nl platform. If you place an order through this platform, Marktplaats.nl shares your order and personal details with us. We use this data to process your order. Purpose of data processing

General purpose of processing

We use your data exclusively for the purpose of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later time—other than at your request—we will ask for your explicit permission to do so. Your data is not shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all bound by confidentiality based on the agreement between them and us, or by an oath or legal obligation.

Automatic data collection

Data collected automatically by our website is processed for the purpose of further improving our services. This data (for example, your IP address, web browser, and operating system) does not constitute personal data. Cooperation with fiscal and criminal investigations: In certain cases, SMPL International may be legally required to share your data in connection with government-led fiscal or criminal investigations. In such an event, we are compelled to share your data, but we will resist this within the possibilities offered to us by law.

Retention periods

We retain your data for as long as you are a client of ours. This means we will keep your client profile until you indicate that you no longer wish to use our services. If you inform us of this, we will also treat it as a request to be forgotten. Due to applicable administrative obligations, we are required to retain invoices containing your (personal) data; we will therefore store this data for the duration of the applicable term. However, employees will no longer have access to your client profile or any documents we created as a result of your assignment.

Your rights

Under applicable Dutch and European law, you have certain rights regarding the personal data processed by us or on our behalf. We explain these rights below and how you can exercise them.

To prevent misuse, we generally only send copies of your data to the email address we already have on file. If you wish to receive the data at a different email address or, for example, by post, we will ask you to provide identification. We keep a record of processed requests; in the case of a request for erasure, we keep anonymized data. You will receive all copies of data in the machine-readable format that we use within our systems.

You have the right at any time to file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) if you suspect that we are using your personal data incorrectly.

Right of access

You always have the right to access the data that we process (or have processed) that relates to you or can be traced back to you. You can submit a request to this effect to our privacy representative. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data at the email address we have on file, along with an overview of the processors who hold this data, stating the category under which we have stored this data.

You always have the right to have the data that we process (or have processed) that relates to you or can be traced back to you rectified. You can submit a request to this effect to our privacy representative. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the email address we have on file that the data has been updated.

Right to restriction of processing

You always have the right to restrict the processing of data that we process (or have processed) that relates to you or can be traced back to you. You can submit a request to this effect to our privacy representative. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the email address we have on file that the data will no longer be processed until you lift the restriction.

Right to data portability

You always have the right to have the data that we process (or have processed) that relates to you or can be traced back to you transferred to another party. You can submit a request to this effect to our privacy representative. You will receive a response to your request within 30 days. If your request is granted, we will send you copies of all data about you that we have processed, or that has been processed on our behalf by other processors or third parties, to the email address we have on file. In such a case, we will likely no longer be able to continue our services, as the secure connection of data files can no longer be guaranteed.

Right to object and other rights

In certain cases, you have the right to object to the processing of your personal data by or on behalf of SMPL International. If you object, we will immediately stop processing your data pending the resolution of your objection. If your objection is justified, we will provide you with copies of the data that we process (or have processed) and then permanently cease processing.

You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in a way that makes this right applicable. If you believe this is the case, please contact our privacy representative.

Changes to the privacy policy

We reserve the right to change our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy affects how we process data we have already collected about you, we will notify you by email.
